August 15, 1969, appellant, Barbara Schroud, signed a petition for an order terminating her parental rights to Thomas Andrew
Schroud, born to her out of wedlock on July 20, 1969. Appellant was a minor at the time the petition was filed but subsequently
reached her majority on August 26, 1969. On September 23, 1969, following an adjournment on September 12th, at appellant's
request, a hearing was held on the petition. After appellant was thoroughly questioned with regard to her understanding of
the proceedings and had executed a written consent, the court entered an order for the termination of her parental rights.
September 18, 1970, appellant petitioned the county court for a rehearing on the grounds of newly discovered evidence. Appellant
alleged that the statutory procedure was not followed in that a guardian ad litem had not been appointed for her and that
her consent was the result of undue influence and coercion. The motion was denied following a hearing on September 30, 1970.
An appeal was taken to the circuit court, and on December 17, 1970, by written decision, the circuit court affirmed the order
of the county court. On appeal from the order of the circuit court, it is contended: (1) That the proceedings were void for the failure to appoint
a guardian ad litem for the appellant; and (2) that the appellant is entitled to a hearing in order to present newly discovered
evidence on a challenge of the voluntariness of her consent.
